1. Who we are
SpeakCents ("SpeakCents", "we", "us", or "our") is operated by Digital Genius LLC. By creating an account, accessing, or otherwise using SpeakCents (the "Service"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree, do not use the Service.
2. Eligibility & account
You must be of legal age to form a binding contract to use the Service. If you use the Service on behalf of an organization, you represent that you have the authority to bind that organization. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must provide accurate information and keep it up to date.
3. The Service
SpeakCents provides voice-first budgeting, transaction tracking, goal planning, and retirement scenario tools. We grant you a limited, non-exclusive, non-transferable right to use the Service within your selected plan. You must not: (a) use the Service unlawfully, for fraud, spam, or infringement of intellectual property; (b) interfere with the Service's security (including malware, probing, or scraping); (c) reverse engineer or resell any part of the Service; or (d) circumvent technical limits.
4. Intellectual property
The Service and all associated software, documentation, content, and branding are owned by Digital Genius LLC and its licensors. You retain ownership of the content you submit (such as transactions, notes, and voice recordings), and grant us a limited license to host and process it solely to provide the Service.
5. Payments, subscriptions, and billing
SpeakCents is operated by Digital Genius LLC. Payments are securely processed through our trusted merchant account and payment processing provider (Paddle.com).
All subscription payments, billing, tax processing, cancellations, and refund requests are managed securely through our payment processing system.
Subscriptions automatically renew at the billing interval selected during signup until canceled. You can cancel your subscription at any time through the Subscription page within the SpeakCents app.

6. Service availability
We work hard to keep the Service running, but we do not guarantee that it will be uninterrupted, timely, secure, or error-free. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
7. Financial disclaimer
SpeakCents provides budgeting and retirement modeling tools for informational purposes only. It is not financial, investment, legal, or tax advice, and is not a recommendation to buy or sell any product. Decisions you make based on the Service are your own responsibility.
8. Suspension and termination
We may suspend or terminate access to the Service for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. On termination, your right to use the Service ends. You may request export or deletion of your data via the app before your account is closed.
9. Limitation of liability
To the maximum extent permitted by law, our aggregate liability arising out of or relating to the Service is capped at the fees you paid to Paddle for the Service in the twelve months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill. Nothing in these Terms excludes liability for fraud, death, or personal injury where such exclusion is prohibited by law.
10. Indemnification
You agree to indemnify and hold Digital Genius LLC harmless from claims arising out of your content, your unlawful use of the Service, or your breach of these Terms.
11. Changes
We may update these Terms from time to time. Material changes will be communicated in the app or by email. Continued use of the Service after changes take effect constitutes acceptance.
12. Governing law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of laws principles. Disputes will be resolved in the state or federal courts located in Delaware.
